Get Tickets Order tickets onlineà or get to the museum early to get tickets. Dont be fooled into thinking that you dont need tickets just because you can enter the museum without them; the tickets grant you access to the permanent exhibit, which is the most interesting part of the museum. The tickets have times on them, the earliest being 10-11 a.m. and the latest being 3:30-4:30 p.m. One way to bypass some of the ticket trouble is to become a member of the museum. Although members still need a ticket for timed entry, members get priority on entrance times. If you are a member, be sure to bring your membership card with you on your visit. (If you are thinking about joining, you can contact the Membership Department by calling (202) 488-2642 or writing to membershipushmm.org.) As an added note, be sure to arrive a bit early so that you will have time to go through the security screening. What to See First The permanent exhibit is the most important thing to see, so keep careful track of when you will be allowed to enter. While waiting for your time, you can visit the special exhibits, Daniels Story, the Wall of Remembrance, the Hall of Remembrance, catch one of the films playing, stop by the museums shop, or grab something to eat at the museums cafe. If you arrive close to your ticket time, head straight to the permanent exhibit. The Permanent Exhibit Recommended for those 11 years or older, the permanent exhibit is the main body of the museum and is filled with artifacts, displays, and visual presentations. Since the permanent exhibit requires a timed pass, try to be timely. Before entering the elevator to go to the exhibit, each person is given a small Identification Card. This I.D. card helps personalize the events and artifacts that you are soon to see. Inside, there is information about a person who lived during the Holocaust. Some are Jewish, some are not; some are adults, some are children; some survived, some did not. After reading the first page of the booklet, you are not supposed to turn the page until you are done with the first floor of the exhibit (which is actually the fourth floor since you start on the fourth floor then work your way down). In the elevator, you are greeted with the voice of a liberator who describes what he saw when finding the camps. When the elevator opens, you are on the fourth floor of the museum. You are allowed to go at your own pace but are on a particular path. The Fourth FloorThe fourth floor covers the years before the beginning of World War II. There are photographs, video displays, films, and artifacts that explain the increase of terror from 1933 to 1939. The displays describe the book burnings, the Nuremberg Laws, Nazi propaganda, the science of race, the Evian Conference, and Kristallnacht. One of the most powerful exhibits was an unrolled, torn Torah scroll, which the Nazis had pulled from its ark during Kristallnacht. An exhibit that continues to all three levels of the permanent exhibit is the pictures that represent the 3,500 Jewish people who lived in the Eishishok shtetl. The Third FloorThe third floor covers the Final Solution, 1940 to 1945. The first section of this floor is about the ghettos. Notice the stones you are walking on (theres a small sign but hardly noticeable). These originally paved a section of Chlodna Street in the Warsaw Ghetto. The next section covers the mobile killing squads, deportation, and camp life. Two e xhibits on this floor are very powerful. The first is one of the cattle cars that carried the victims to the camps. The second exhibit is the one on medical experiments. With video displays in which you have to look over a concrete wall and down into (most likely to protect children from seeing it), shows very gruesome pictures of the experiments, including air pressure, seawater, and skeleton collection. The Second FloorThe second floor is the Last Chapter that covers the rescuers, resistance, and liberation. There are a lot of visual pictures documenting what was found in the camps. For most of the victims, liberation had come too late. Special Exhibits The special exhibits change frequently but are certainly worth going through. Ask at the information booth in the central floor of the museum for information (and maybe a brochure?) on the exhibits. Some recent and past exhibits include the Kovno Ghetto, the Nazi Olympics, and the St. Louis. Daniels Story Daniels Story is an exhibit for children. It usually has a line to go in and is crowded throughout the exhibits path. You start the exhibit with a short film (you remain standing) in which you are introduced to Daniel, a young Jewish boy. The premise of the exhibit is that you are walking through Daniels house looking at things that Daniel used every day. It is through touch that the children learn about Daniel. For instance, you can flip through an enlarged copy of Daniels diary in which he has written a few short descriptions; look in the drawer of Daniels desk; move windows up and down to see before and after scenes. Wall of Remembrance In a corner of the museum, there are 3,000 tiles painted by American children to remember the 1.5 million children murdered in the Holocaust. You could stand for hours in front of these tiles, trying to look at each one, for each tile has a unique scene or image. Hall of Remembrance Silence fills this six-sided room. It is a place for remembering. In the front is a flame. Above the flame reads: Only guard yourself and guard your soul carefully, lest you forget the things your eyes saw, and lest these things depart your heart all the days of your life. And you shall make them known to your children, and to your childrens children.- Deuteronomy 4:9 Lillyhttp://www.blogger.com/profile/17006306846284201040noreply@blogger.com0tag:blogger.com,1999:blog-4644940719662654229.post-51868540378199967242020-02-23T13:27:00.001-08:002020-02-23T13:27:02.925-08:00EU LAW Term Paper Example | Topics and Well Written Essays - 1500 wordsEU LAW - Term Paper Example This implies that there was the evolution of certain relevant legal principles from a national level to conform with European Union laws and systems. The potential conflict led to the creation of the General Principles of European Union Law. The General Principles created a framework through which the new legal instruments of the common market could be streamlined and applied in all national jurisdictions (Tridimas, 2006). The General Principles include a set of concepts that guide the courts in the enforcement of European Union Laws (Schwarze, 2006). They are invoked to ensure that the potential tensions between EU law and local laws are minimized. More importantly, they are applied to ensure that the spirit of the European Union law is honoured in cases. They main concepts in the General Principles of EU Law include fundamental right, proportionality, certainty, equality and subsidiarity (Foster, 2011). Individuals can therefore request for review of their cases on the bases of these principles when they feel it is not fully honoured. Optimal outcomes as I perceive, necessarily pertain to aspects such as better health care and lower medical cost/ expenditure. In line with this is the need of the nursing fraternity to aptly adapt to the expected dynamism within the healthcare system. Conformity subsequently necessitates various changes, in line with tackling influential structural issues like utility of contract medical employees, unit restructuring and foreclosure, nursing shortage and turnover rates, staffing ratios, magnet designation, patient satisfaction, and continuous improvement of quality healthcare provision (Oââ¬â¢Donnell & Bensky, 2011). A critical issue amongst the aforementioned would be patient satisfaction in terms of overall treatment and positive result outcomes. Towards tactfully addressing this issue, is the need of overall conformity that necessitates a variety of changes. Definitively, the optimal course of direction is towards evolving healthcare into a more patient-centered profession. In such contexts, optimal healthcare ought to be responsive to and respective of personal preferences, needs and values of the individual patient. Through this, leadership and management can strategically strive towards ensuring that individual patient values do guide all forms of clinical decisions. Influential in this regard as Bohm (2012) alludes, is the fact that there has long lacked the incorporation of patient-centered care especially in terms of care quality assessments, as well as subsequent health outcomes. Rather, quality measurement has continuously focused on addressing preventive care and disease-specific processes instead. S. Right now the market for womens professional sports is growing rapidly. The best way for womens sporting organizations to promote and sell this market is to align with previously established organizations such as the NBA, NCAA and the USOIC. Although joining with mens organizations is a difficult process that involves compromise, merging with these organizations helps to land big television contracts, gives greater publicity, and brings in endorsements, advertisers and investors. The lack of these benefits was among the key factors in the failure of the ABL. Inversely, these are the reasons for the successes of the WNBA and womens sports in the Olympics. Throughout the history of female athletics merging with male sports organizations has not always been a pleasant experience. In 1982 the AIAW merged with the NCAA, despite the NCAA fighting tooth and nail to try and find ways out of Title IX, an act of Congress that required Universities to provide equal funding for womens athletics. The NCAA did everything they could to stop the equal funding but finally gave in during the 1990s. Right now the NCAA embraces its womens sports programs and has had many women represented on the executive committee roster and even has a committee on womens athletics. Also, the NCAA has worked out television contracts with ESPN, FOX sports and CBS. This has lead to not only coverage of womens sports but publicity. Womens games are talked about on Sports Center and College Hoops Tonight everyday during the season. The addition of the womens to the Olympics did a lot more to promote commercial secures and the advancement of womens The Womens Olympic Games went out of business shortly after the Olympics allowed women to participate. Women lost a lot with this merger at first due to the fact that women were prohibited from many Olympic events that they could have participated in as part of the Womens Olympics. These restrictions werent lifted until 1984. However in the long run co-ed Olympics are beneficial for womens sports. At the 2002 Olympics at Salt Lake City there was only two sports that USA women did not compete in, ski jumping and the Nordic combined. Female athletes were well represented even though there were a few more male athletes in some events and the television air time was almost equal for both sexes. The ABL never stood a chance against the WNBA. The ABL a independent womens league and the WNBA, a subsidiary of the NBA, played a big part in putting the ABL, a separate womens basketball league out of business. The WNBA could afford to pay players less because the players could receive a lot more publicity and endorsement playing in the WNBA. The ABL made huge mistakes right off the bat. First off there season was from October to March right and competing with the NBA and the college basketball season. Thus it was harder to land large television contracts. The could only get contracts on lower budget cable stations the Black Entertainment Television and some but not much regional coverage on the Sports Channel ( now Fox Sports). In their third and final year they did not renew the contact with BET and Fox Sports would show 16 games, a 61% decrease of games seen on TV . However they did work out a deal with CBS that would show two ABL playoff games. League went under before they could even finish the season. With the help of the NBA the WNBA was able to avoid costly mistakes while using the pervious existing structure of the NBA and its capital to increase the popularity of the WNBA and ensure some financial security. The WNBA had NBA marketers and promoters and big television contracts on NBC, Lifetime and ESPN. The WNBA just this season will be showing a lot more games the ever before. The LA Sparks will receive 22 of their 33 games televised nationally More importantly the WNBA had money behind it, commercial on NBC billboards all over there home cities and their marquee players such as Lisa Leslies were in shoe commercials. The market for womens sports is growing rapidly and a big part of this success is because of these mergers with established organization. These mergers of womens and mens sports can do a lot more for the promotion and the TV coverage then any newly formed league male or female, an example of the is the WNBA and the Olympics. Although the history of these mergers has had a shaky history in the past those days are over. There is a lot of money to be made on womens sports if promoted right and if leagues like the WNBA fail it would be a major set back for womens basketball so why not have the NBA and all its promoter TV contracts and executive expertise behind them. He attributes the increase in economic inequality to Malaysiaââ¬â¢s green revolution. Consequently, Scott analyzes the impact of these changes on the poor, sighting several causes. à à à à à The green revolution began in the 1970ââ¬â¢s in Malaysia. It was brought about by an advance in technology, a new form of high yielding seeds. These new seeds led to the ability to double crop, or have more than one crop yield per season. Also, many of the large farmers opted to bring in combine harvesters to increase the speed at which they could harvest, making it easier for them to double crop. These new technologies may seem economically beneficial to all if viewed by the untrained observer. However, those who benefited were few. These new developments only benefited the wealthiest in society, consequently leaving the poor even poorer for many reasons. à à à à à More than anything the combine harvesters led to the increased troubles of Sedakaââ¬â¢s poor. ââ¬Å"Combine harvesting has meant, then, a loss of nearly half the wages previously received for paddy work by the poorer strata of Mudaââ¬â¢s peasantry (76)â⬠. Combine harvesters were valued by many large farmers as brilliant new technology. It allowed for them to eliminate the need of a labor force for cutting and threshing. ââ¬Å"By the irrigated season of 1979 â⬠¦ they (combine harvesters) were harvesting fully 60 percent of Sedakaââ¬â¢s patty land. A year later they were harvesting more than 80 percent (115)â⬠. Transplanting was the only work left for patty workers in Sedaka. Thus a problem presented itself for the one-quarter of Sedakaââ¬â¢s population who subsisted solely from wage labor. Combine harvesters also allowed for large farmers to take up the practice of broadcasting, which took work away from those who helped with the pre-season planting. The lack of work led to a decrease in the need for laborers. Since there was less demand for laborers, the price of wages went down. This greatly affected those who did not have enough land to provide year round subsistence for their families. This group of poor who farmed less than 3 relong, in other words those considered below the poverty level, had to struggle to survive. Some peasants had to move temporarily or permanently to larger cities to find work to provide for their families. This period in the Ancient Indian history has been regarded as Vedic period which is the time when Vedic Sanskrit texts were composed in India. The society and civilization which evolved during that time has been known as Vedic civilization which flourished on the Indo-Gangetic plains of the Indian subcontinent. Vedic literature is of paramount importance in the understanding of the social, economic and religious flavors of India. Among all modern Indian philosophic systems the Vedic tradition is the foremost. It has been recognized as the sound platform on which the pillars of Hinduism has evolved. Vedic literature has an infallible reputation for the evolution of Hindu orthodoxy, and is composed of three classes: the collection of hymns, incantations and sacrificial formulas. These are the first tentative Indian philosophy. (Navone, 1956). The Vedic Literature can be classified as the basis for the Hindu Vedic civilization. They are classified into several chronological branches. Rig Veda is considered the oldest of the text and consists of many elements which have common thread with the Indo-Iranian texts both in language and content. Such similarity does not exist in reference to any other text. (Vedic Age)This is followed by the ââ¬Å"Brahamanasâ⬠or theological prose testimonials; the ââ¬Å"Aranyakas,â⬠containing the meditations of the woodland hermits and the ââ¬Å"Upanishadsâ⬠the secret doctrines. (Navone, 1956). These are the first tentative Indian philosophy which has been the foundation for later development of the values and the beliefs of Hinduism through ages. The depth of context and content provided by the Vedic literature has attracted great explorers and later missionaries to rediscover the essence of India during the Vedic period. The true scientific knowledge of India became available when the study of Sanskrit and other ancient languages was first undertaken. Rigveda forms the backbone of the Hinduism and the compositions of this time has great impact on the society and the culture of the time. The political units were divided into three segments and the heads were appointed for each segment. The three segments were ruled by Rashtra and the head of the state was considered Rajan or the King. It was a democratic system where the King ruled with the consent and the approval. The King was in charge of the protection and justice of the citizens. The society and economy evolved where agriculture flourished and the cows and bulls held important sacrificial significance. The caste system evolved and marriage rules became strict and families evolved as patriarchal where the birth of the son was considered significant. Religion evolved with great emphasis on worship. Rishiââ¬â¢s , composers of hymns were considered divine. Yoga and Vedanta became the basic elements of religion. People worshiped the elements of nature Sun, Moon , Wind, Rain, Dawn and Earth. The greatest exponent of Vedanta was Shankracharya, he referred to a definite system and defined doctrines differentiating from the other similar systems. The most radical divergence of Vedanta was its teaching that the world originated from a single principle. (Navone, 1956). Bibliography Navone, J. J. , S. J.. Hawaiiââ¬â¢s homeless population should be addressed by the government because they affect tourism in a negative way. Mainlanders come to Hawaii to live on the streets. We ha ve a better weather climate compared to the mainland. This allows the homeless to come all the way here to live. With them on the street, it increases the population on the street. There are no official evidence of where they are coming from. Take a look at the two prepositional phrases in the following sentence: The steamy air in the kitchen reeked of stale food. The first prepositional phrase --à in the kitchen --à modifies the noun air; the second --à of stale food --modifies the verb reeked. The two phrases provide information that helps us understand the sentence as a whole. The Two Parts of a Prepositional Phrase A prepositional phrase has two basic parts: a preposition plus one or more nouns or pronounsà that serve as the object of the preposition. A preposition is a word that shows how a noun or a pronoun is related to another word in a sentence. The common prepositions are listed in the table at the end of this article. Building Sentences With Prepositional Phrases Prepositional phrases often do more than just add minor details to a sentence: sometimes theyre needed for a sentence to make sense. Consider the vagueness of this sentence without prepositional phrases: The workers gather a rich variety and distribute it. Now see how the sentence comes into focus when we add prepositional phrases: From many sources, the workers at the Community Food Bank gather a rich variety of surplus and unsalable food and distribute it to soup kitchens, day-care centers, and homes for the elderly. Notice how these added prepositional phrases give us more information about certain nouns and verbs in the sentence: Which workers? The workers at the Community Food Bank. What did they gather?A rich variety of surplus and unsalable food.Where did they gather the food? From many sources.Who did they distribute it to?To soup kitchens, day-care centers, and homes for the elderly. Like the other simple modifiers, prepositional phrases are not merely ornaments; they add details that can help us understand a sentence. Arranging Prepositional Phrases A prepositional phrase often appears after the word it modifies, as in this sentence: Ben slipped on the top rung of the ladder. In this sentence, the phrase on the top rung modifies and directly follows the verb slipped, and the phrase of the ladder modifies and directly follows the noun rung. Like adverbs, prepositional phrases that modify verbs can sometimes be shifted to either the beginning or the end of a sentence. This is worth keeping in mind when you want to break up a long string of prepositional phrases, as shown here: Original: We walked down to a souvenir shop on the waterfront after breakfast in our hotel room.Revised: After breakfast in our hotel room, we walked down to a souvenir shop on the waterfront. The best arrangement is one thats clear and uncluttered. Building With Simple Modifiers Use adjectives, adverbs, and prepositional phrases to expand the sentence below. Add details that answer the questions in parentheses and make the sentence more interesting and informative. Jenny stood, raised her shotgun, aimed, and fired.( Where did Jenny stand? How did she aim? What did she fire at?) There are, of course, no single correct answers to the questions in parentheses. Sentence-expanding exercises such as this one encourage you to use your imagination to build original sentences. His writing is credited as some of the most influential pieces written in English literature. Shakespeare was born in 1564 in England. He attended school, but did not further his formal education after dropping out of grammar school. In 1590, he left his wife and three children in order to become a playwright and actor. He was successful with this, and, because of his reputation, became a popular playwright in England. After his death in 1616 at the age of fifty-two, his work became some of the most reputable works of all time. They have been enjoyed as timeless classics to this day. The works I have chosen to compare are Romeo and Juliet and Much Ado About Nothing, both ofâ⬠¦show more contentâ⬠¦Much Ado About Nothing is a comedy nowhere near as dismal as its comparison, Romeo and Juliet. This play is centered around a couple many see as fit for marriage, except the two ââ¬Å"lovebirdsâ⬠are unable to see that for themselves. Though the courting couple may be older, their unbelievably funny wit and inability to recognize their passion for eachother is what makes this play so great! Though the plays are both of different genres, each encompassess aspects of an incredibly entertaining, informative piece. I say this because of the themes Shakespeare presents throughout the works, the complexity of characters, and the allegorical messages present throughout the plays. Both of the works I have selected are entertaining and informative pieces because of the themes Shakespeare presents throughout them. Shakespeare is known for incorporating sappy, cliched romance into his plays. Unfortunately, with Shakespeare, romance does not exclude tragedy. In my opinion, this is what makes his work so enjoyable! In Romeo and Juliet, the ongoing Montagues-Capulet family feud leads young Romeo and Juliet to have a difficult time furthering their relationship. Though madly in love, tragedy in the form of suicide strikes the both of them. In Act 5, Scene 3, Romeo and Juliet make the ultimate sacrifice and kill themselves in order to continue their love in death. Romeo chooses poison as his killer, and Juliet chooses Romeoââ¬â¢s dagger as hers. ââ¬Å"O happy Lillyhttp://www.blogger.com/profile/17006306846284201040noreply@blogger.com0tag:blogger.com,1999:blog-4644940719662654229.post-75770341866172977352019-12-11T07:34:00.001-08:002019-12-11T07:34:03.000-08:00Outcomes of Earnings Guidance and Management - MyAssignmenthelp.com Question: Discuss about the Outcomes of Earnings Guidance and Management. Answer: Introduction McDonald's is one of the most popular franchises in the world that serve quick food services to the people. It is a fast food company that is based out of America. It was started in 1940 and since then it has grown and spread to many countries of the world. By 1965, there were more than 700 McDonalds franchise around the world and by 1970 it became a very big international brand that was having operations in every part of the world possible. The stocks of the company are listed on the U.S stock exchange and with the expanding of the franchises the suppliers have also spread to different part of the world. McDonalds is a brand that is synonymous to happiness and people relate it with many fond memories of growing up. McDonalds Chinese Crisis. In 2014, the company faced a very big crisis that was reported worldwide. The company had more than 2000 outlets in China, but in the year of 2014, it faced a meat scandal because of which the company had to bear huge losses and their overall image was also tainted. A video surfaced that showed how contaminated meat was used to process food inside a factory in Shanghai, which was captured secretly by a local reporter. This caused wide scale uproar and it was found that meat processing factory was supplying the same to many international food brands and that raised a question on the quality of food that McDonalds was offering to its customers (Hang, Y. and Wang, M., 2014). The Shanghai Municipal Food and Drug Administration decided to investigate the matter from there on end and found that the suppliers were repacking expired meat products into new valid packets and supplying to many international brands. Most of the companies that were related to this supplier broke all ties with the m, however McDonalds continued to keep their relationship with the supplier alive(Li, et al., 2017). It believed that the quality of meat that was produced by the supplier was better then what was produced by many local markets, but later when actions were taken by the food regulation authorities it was found that the quality of meat was terrible and that had banning of many meat products like chicken wings, chicken nuggets that the company was producing. For areas that the company was having different supplier it was unaffected. But people had lost there confidence in the products and the company and were not very skeptical in buying products from areas other than China and Japan(Kohtamki, 2017). They were concerned about the health issues and the safety standards that were followed by the company. It was also seen that the company claimed that in areas around Hongkong the company was having different supplier, but it was later found that the raw material was transported from the s ame supplier. So in that way they lost confidence of the public. Therefore, it led to huge loss of revenue for the company as many of its products were banned and the company was having huge operation in China. McDonalds in Japan was also affected as more than 20 percent of the total supplies were from the same supplier(Mayntz, 2017). Graph showing the effect on the overall sale of Mcdonalds because of the crisis There were many regulations and laws that were introduced post this incident and pledge was taken to keep the food safety standards up to the mark. China and Japan accounted for more than 10 percent of the total revenue for the company. However, after this crisis the sale and revenue showed a great fall and the company had to bear huge loss. The company tried to change the flow of wind, by immediately responding to the situation and removing all such contaminated products from the market but the damage was already done and that had caused a huge loss of reputation for the company. The company suffered on many ends not just financially but also as a brand the company was affected. McDonalds China still was quick enough to response; however, the McDonalds japan failed to take the necessary steps. They removed the products from the market only after the news of the crisis suffered. They were not concerned about the health of the general public but were concerned about the financial info rmation of the company. So thus, In Japan there was huge opposition against the company and the company had to suffer very badly. Thus, this response from the company was criticized from many ends; the public came to know about the crisis from other sources, rather than company announcing the same through a proper channel of network. This created panic situation among the people and they criticized the company and for a long time they abstained from buying McDonalds product even those that were not prepared from meat(Mayntz, 2017). The press conference that the company conducted to address this issue was also a major failure. The speaker failed to address the issue correctly and was unable to convey the McDonalds part of the story. Thus, we see that the overall crisis management by the company was not up to the mark. This was the main reason why the company lost on some very valuable and loyal customer and the overall brand was also affected(Maynard, 2017). Problem solving approach by the Company Later the company tried to take the situation in hand by making people aware about the various steps that they were taking to maintain the quality standards and that they have broken all contacts with those suppliers was also communicated. The company tried to improve the overall position that it previously had by introducing new products and carrying out the overall branding and promotion based on the same. But there were many areas where the damage was too high and the company is still trying to recover from the same. It has been three years from that time, the company has taken many steps since then to make sure that they do not face any such situation in future, but there are many changes that the company can bring in its present crisis management system that would eventually help it to avoid such situations in the time to come(Pape, 2017). Problem solving Application Case (PSAC) was applied by McDonalds to address the issue that the customers were facing and something that would eventually help them to roll out new menus as per the demand of the customer. It helped McDonalds to perform really well in situations when the company was facing an economic downturn. When the meat crisis hit the company hard, it tried to give out new menus that consisted to low calories wraps and snacks at affordable prices. It was a challenge for the company to satisfy the need of the customer and provide them food as per their preference. The company also tried to satisfy the need of the customer, and make sure that they have trained professionals who can satisfy their grievances(Tian Slocum, 2016). There were complaints that the employees of the company were not able to solve their problems, so the company decided that every franchise must employ and train employees who were able to deal with the customer better. Thus we see that the comp any tried to solve the issues that cropped up because of the crisis that it faced. The major factors that was governing the flow of resources at the time of crisis management on part of the company were- Technological factors- The company needed a strong communication line that would have helped in making the public aware about the situations that the company was facing with regards to the ban. The necessary steps that they were taking for their consumer should have also been highlighted through those channels. So that would have helped in sustaining the confidence of the public in the company. But what we notice is that the company was not able to make use of any such channel effectively and that had made the overall situation worse for the company(Minnis Sutherland, 2017). Economical factors The present state of the economy in which the company was operating was also a factor that had affected the overall crisis management. The company had operations in many countries and all of these were interlinked, so the present situation of economy in those country was affecting how the company was functioning and the steps that the government was taking to make sure that the operations were stopped was also affecting the company(Saad Elshaer, 2017). Social factors The company has been in the business from decades, and the people associate with the same like their own. They had a lot of sentiments that was attached to the brand and all of that was affected because of this crisis and thus that led to the company loosing many of its loyal customers. The social stigma that it caused was also one of the factors that had affected the flow of the crisis management on part of the company(Rodriguez Kaczmarek, 2016). But there were many other models that the company could have resorted to and that would have resulted in better results. There are two models that the company could have considered that would have helped them in achieving the Profit maximizing model The company should go for such approach that could help them in maximizing the profit, and help them in recovering the losses that they have incurred because scenario where most of their products were banned (Xu, Y., 2014). The company should have gone for such an approach that would have helped in reducing the total costs that the company has incurred and would have also helped them in earning some revenues that would have helped them in achieving the break even in the future. But what we see is that the all the efforts that were put by the company were to reduce the total amount of losses and not to improve the profit elements(Lubensky, 2017). There are two approaches that the company could have taken in case of this model namely- Short run growth of the Profit This includes increased amount of profit in the shortest of time period, this may include increased efforts on part of the company that would include more items in the menus, good amount of branding and promotion, efforts to improve the customer satisfaction and introducing discounted meals so that the company can earn effective profit in small time period (Cogin, J.A. and Williamson, I.O., 2014). Long run growth of the profit- This will include changing the system entirely, that would include, changing the way the company behaves, the company tackles the crisis and making overall changes in the net cost benefit ratio, so that these changes helps the company in making increased amount of steady profit in the future. This is how the company will be able to bring changes in the core strategies that would help it in bringing long term changes in the times to come (Osman, H., Johns, N. and Lugosi, P., 2014). The company can also appoint experts in the field of finance and management that would have helped them in ensuring that in times to come, how the company can maintain its cost benefit analysis and the necessary steps that the company must take in that regard. But the short term and the long term profit methods are good and the choice depends on the company and what basis does it wants to follow to achieve the same (Pfeffer, J., Zorbach, T. and Carley, K.M., 2014). This is more of a resource based approach where the company needs to analyze the overall resources that it has, and draw up a budget on the total cost that it has incurred including the cost of the crisis and the required profit level that will help the company to break even. Thus all this needs to be researched before the company can go forward this model of crisis management (Akgn, A.E., Keskin, H. and Ayar, H., 2014). Strategic Crisis management One of the most effective used methods of dealing with such insane situations where the company is seeing that the overall trust of the public is being lost is to apply proper formula strategic analysis that will help the company to deal with such situations better. When the company came to know about the uproar that the suppliers issues had created, the company should have informed the general public through proper channels. This would have helped in marinating the overall confidence of the public in the company and the brand value would have been maintained. Also one of the major mistakes that was apparent on the part of the company was not to take such appropriate steps when the issue became relevant in Japan (Brown, R.S., 2014). Thus we see that the items should have been removed by the company before the ban on the same was stated. In this way the company would have been able to show that it cares about its customer more than its own profit. This is where the company lost its po sition of being the brand that it was and the customer also lost its confidence. Thus strategic method should be followed that would have helped the company in identifying the various routes through which communication can be given to the general public. The experts can be appointed who would have helped the company in managing the things better and would have made the situation a little better. The company could have also done market research and analysis before saying the products in Hong Kong where not made by the same supplier (Mosley, R., 2014). So we see that in this place the company lacked the basic knowledge about its own suppliers and that backfired on the company. So in future when such situation or any such crisis occurs the company should go for the strategic way, should maintain its level of composure and then the management should take the necessary steps. It is very important that the trust of the public is maintained because people makes a brand and all the activiti es of the company must be consumer centric. So thus in future the company should see to it that all the suppliers are secure, timely audits and checks must be done from the part of the company (Shakhshir, G., 2014). This will help them in maintaining their own level of safety and safety of the consumer. All the rules and regulations as set by the government in regards to food safety and standards must be followed by the company. It must be seen that all the products that the company manufacturers must see the safety standards (Loftsdttir, K., 2014). So thus we can say that by applying this strategic approach the crisis could have been handled a bit better and the overall losses that the company had incurred would have also reduced. Thus the after effects of the crisis and the damage that it did to the company would have reduced considerably (Ghobadian, A. and ORegan, N., 2014). Conclusion On the basis of the above analysis it can be said that the best approach that the company could have adopted during the time of crisis was strategic management. This had its share of advantage and would have helped the company to maintain its profitability for a longer period. It would have helped in achieving the long term goals of the company, making sure that in times to come the company does not faces any such situation(Zhao, 2017). As a consumer, once if the trust from any brand is lost, it becomes very difficult to regain the same. So in that situation it was very tough on part of the brand to proof that it was maintaining the required standards of safety and the food that it was providing to its consumer was up to the mark(Anginer Kunt, 2014). So that is where strategic management would have helped, it would have made sure that not only the situation that the brand was facing was dealt effectively, but also the regained trust of the public is affirmed. This would have helped in maintaining the long term profitability of the company and the solutions would have affected the coming times in the future the overall operations of the company. It was very important for the company to recover from such a big loss, the overall steps that the company followed were also not bad, but out of all the three models that were there, the strategic management of the crisis was the best approach(Feng Koch, 2010). It is a chemical reaction, which occurs when light hits a film or paper emulsion. An emulsion is part of the film or paper, which is very sensitive to light. This is also the part where the chemical reaction takes place. In an emulsion, are small crystals of silver halide, silver bromide, silver chloride, or silver iodide [Eaton, George]. These chemical crystals react with light when it is passed through a camera, to create an image on paper [Foto Info]. The development of film production has a very simple chemical equation, most widely known as: Light + Ag(X) ? Ag + (X) This equation expresses how when any form of light is added to silver X, it creates silver plus the X [Mad Scientist]. In most cases, the AgX represents one of the compounds above. In the photographic process, there are three main chemicals used. These are the developer, the stop bath, and the fixer. The developer, or the reducer, is the chemical that completes the reaction with the light exposure, by reacting with the silver, to create metallic silver [Britannica Online]. This process is called reduction. Common reducers used are hydroquinone, phenidone, metol, pyro, and absorbic acid. If you combine two of these reducers, it creates superadditivity. Some common combinations are metol and hydroquinone, which produce MQ, or phenidone and hydroquinone, which produce PQ. [Foto Info] Each of the chemicals used in the developer have their own specific qualities and features. When hydroquinone is used alone, it can be a very slow reducer. When metol is used, it brings out detail very quickly. Phenidone is almost never used by itself. If it is combined with hydroquinone, it keeps detail, but at the same time, it increases contrast. If used alone, it is very fast but has low contrast. One of the less commonly used of these developers is pyro. This is an older developer, and is also known as pyrogallol. Pyro leaves a stain on the negative while it develops it. Most people who use this developer want that stain as part of an effect, because it ends up softening the image. Finally, absorbic acid has been used for quite some time to develop film. [Foto Info] The Kodak DK-50 is a fast developer, which produces a clean image on the paper. A breakdown of the chemicals involved looks like this: Water 52 degrees centigrade 750 ml Metol 2.5 grams Sodium Silfite, anhydrous 30 grams Hydroquinone 2.5 grams Balanced Alkali 10 grams Potassium Bromide, anhydrous 0.5 grams [Kodak] This shows the amounts of each chemical added. If you change the amount of these chemicals, or add different ones, the developer will create different qualities in the pictures it makes. An example is in the Kodak D-76 Developer. This developer is good for shadow detail, and has normal contrast. The makeup of this developer looks like this: Water 52 degrees centigrade 750 ml Metol 2 grams Sodium Silfite, anhydrous 100 grams Hydroquinone 5 grams Borax 2 grams [Kodak] A stop bath makes sure the developer does not develop any more than it should, by stopping it [Britannica Online]. This is needed because there is always some extra developer in the emulsion. A developer has a pH higher than seven, and is therefore a base. Most photographers use acetic acid as their stop baths [Foto Info]. This acid neutralizes the developer, causing it to stop. Another simple stop bath is water. The only problem with this is that water will not stop the development of the photo instantly. This is generally not a problem, unless the artist has a specific look that they are trying to achieve. The last chemical in the photography process is the fixer. The fixer breaks up the un-exposed silver salts in the emulsion. Then, you will be able to view the photograph outside of the darkroom, because it will no longer have a chemical reaction with the light. There are six components of the fixer. They are the solvent, the fixing agent, acid, preservative, hardener, and the buffer [Woodson, Roger]. The solvent is usually water, which dissolves the chemicals, including the silver thiosulfate complexes that were formed. The fixing agent is usually sodium thiosulfate or ammonium thiosulfate. The principle enables an individual to challenge detention. This is a vital principle in law whose application has largely depended on regimes, the governance approach and security challenges that a government encounters.Advertising We will write a custom research paper sample on Civil liberties, habeas corpus and war on terror specifically for you for only $16.05 $11/page Learn More Various regimes have applied the principle in different ways (Halliday, 2011). The variation in the application has been controversial with the onset of war on terror (WON). Legal hurdles have impaired WON as regimes seek to hold enemy combatants without any trial. However, the presence of this clause limits the ability of authorities to detain suspects without initiating hearings (Fiss, 2006). The congress and the president have the capacity to lift the right to habeas corpus. The application of this right is largely dependent on the security challenges that a regime encounters. As such, the suspension of habeas corpus depends on the security challenges that a government is encountering. Definition of habeas corpus With reference to the American constitution, habeas corpus is a vital principle of freedom. The terminology means ââ¬Ëto avail the bodyââ¬â¢ in Latin. Consequently, it enables individuals to access freedom from detention without any trial. The American constitution affords its citizenry with the right to plea to this legal clause. In such cases, the American government has to answer to the court. The government has to provide concrete reasons for holding a person. Subsequently, the court determines whether the reasons provided are adequate to allow the wavering of this fundamental right. Habeas corpus in America is much similar to the corresponding law in England. The American law emanated from the English statutes. However, there are numerous adjustments in the respective nations to suit their circumstances. There are certain reasons that lead to lifting of this right. They include rebellion and protection of public safety. Over years, the application of habeas corpus has changed with countless infringements by authorities (Hafetez, 2011). War on terror The WON has culminated in controversy owing to the governmentââ¬â¢s detention of civilians believed to be enemy combatants. The application of this vital principle has been violated by subsequent regimes as they seek to detain combatants. The challenge that the government encounters is the prosecution of the alleged combatants in civilian court. As such, the terror charges would not stand before judges and most of the combatants would be set free.Advertising Looking for research paper on government? Let's see if we can help you! Get your first paper with 15% OFF Learn More To prevent this, the government regards enemy combatants as terrorists. This enables the authority to detain such suspects despite the illegality of such detentions. The Bush administration encountered numerous challenges as it was holding suspected criminals without trial. Owing to this challenge, the Bush regime could not effectively execute its strategies during the WOT. Subsequently, it sought to build a holding camp in a place where the American constitution had no jurisdiction. Guantanamo bay was constructed on land leased from the Cuban authority. As such, the American constitution had no jurisdiction. The government held terror suspects on the island without any trial. The right to habeas corpus was not applicable on this detention camp (Fiss, 2006). Cases challenging detention The action to hold detainees in Guantanamo was challenged severally. In Boumediene v. Bush, the court ruled that Boumediene, a Bosnia and Herzegovina national had the right to plead to habeas corpus. Consequently, his detention was illegal. The court decision culminated from 5-4 majority in the ruling. The application of insular cases meant that the American constitution had jurisdiction in Guantanamo since America had complete authority and control over the territory. The decision by the Supreme Court resulted in subsequent cases pertaining to this right. Other suspects sought to plead to this right (Cornell University Law School 2007). However, their efforts were curtailed by legislation. In subsequent cases pertaining to detainees held in the Guantanamo camp, the court ruled that the detention was illegal. Consequently, the government solved the impending crisis by establishing the Combatants status review tribunal. The detainees held in the camp were to face a military commission since the government ruled out trials in civilian courts (Cornell University Law School 2007). Courtsââ¬â¢ role in the implementation of habeas corpus In light of the above cases, the court exercised absolute authority on the ability of any detainee to p lead to this habeas corpus. The jurisdiction of the court limited the ability of the defence department to breach this right. However, to some extent the president prevailed since the detainees did not receive the right to prosecution in a civilian court. If the proceeding were in civilian courts, most of the detainees would be set free. This would hinder the WOT since the civilian courts would set free such detainees. The government viewed the prosecution of enemy combatants in civilian courts as counterproductive (Hephaestus Books 2011).Advertising We will write a custom research paper sample on Civil liberties, habeas corpus and war on terror specifically for you for only $16.05 $11/page Learn More Previous incidences of suspension habeas corpusââ¬â¢ The Congress and the president can exercise their authority and limit the right to plea to this right. President Lincoln did so during the civil war when part of America was under enemy forces. The suspen sion of this rights resulted in the establishment of military courts to deal with the rebels that wanted to seize the capital. However, Lincoln faced an aggressive senate once it resumed from recess. The high court in Maryland overturned Lincoln decision pertaining to the right of habeas corpus. However, the president assumed the courtââ¬â¢s decision and continued to suspend this right with regard to combatants. Once the senate resumed it passed legislation approving the presidentââ¬â¢s action. The presidentââ¬â¢s actions were necessary since American was encountering a rebellion. According to Sir William Blackstone, one of the lords that were pivotal in the creation of this principle the King had to know of any retrains on his subjects. Once the English legal system was fully operation, the legal statues provided that the right could only be waived during a rebellion or an invasion. This is much similar to what the legal statutes in America provide. Similarly, during the S econd World War the president could suspend habeas corpus. However, the court limited the suspension of this right to only crimes that relate to war only. If habeas corpus was suspended, the applicable law only applied to crimes pertaining to invasion, enemy combatants and rebellions. In the above scenario, the courts also limited the suspension of this right. This limits the misuse of the suspension of habeas corpus (Fiss, 2006). Congress and the president The congress being the ultimate legislative body has the capability to determine various aspects of habeas corpus. The congress has enacted laws, which determines the application of habeas corpus. Evidently, alterations to this right mainly result from the security challenges that the nation is encountering. The alterations have sought to approve measures to detain combatants or suspects who threaten the safety of America. The congress first altered the right to habeas corpus was during the Lincoln era, when the president suspend ed this right as the senate was in recess. Despite confrontations in congress, senators ratified the presidentââ¬â¢s executive order to suspend habeas corpus. The second situation, which required the suspension of habeas corpus, was during World War II (Chemerisnky, 1987). Legal changes owing to WON The Oklahoma and twin towers attacks are other security challenges that have culminated in the suspension of this right. The latter resulted in massive legal changes to deal with terror. However, alterations have encountered challenges if they infringe on the constitutional rights of a person.Advertising Looking for research paper on government? Let's see if we can help you! Get your first paper with 15% OFF Learn More The 2001 presidential military order sanctioned detention of individuals believed to partake in terrorist activities without any legal proceedings to prove their innocence. Legal scholars were opposed to such an order since it violated habeas corpus. Despite the approval of detention based on terrorist suspicions, the Supreme Court proved the supremacy of the rights entrenched in the constitution through various rulings such as Hamdi v Rumsfield. Cases such Boumediene v. Bush and Hamdi v. Rumsfield had dissenting justices. However, it was vital that the court observed the constitution. This is because habeas corpus is a basic right for any person restrained by American authorities. Consequently, suspending it without providing a detainee with a chance at justices breaches the basic rights entrenched in the constitution. Unlike in previous scenarios where the legal system shied away from upholding the law when the executive contravenes it, the court emerged as an independent organ of governance by terming the detentions unlawful (Perkins, 2004). Personal views on habeas corpus Habeas corpus is a key right in any free society. As such, it is vital to uphold it. Despite the complex security challenges that this nation encounters, it is paramount to ensure that all detainees have access to a legal process where they can prove their innocence. Terrorist charges should not be a basis to detain an individual without any legal procedure to try the suspect. Terror poses a massive challenge to this society. Subsequently, on the determination of the involvement of a suspect in such activities, the suspect should face appropriate legal process. Where the suspect is extremely dangerous specialized trial procedures should apply. These include military commissions and tribunals. The constitution of such tribunals should have civilian legal representatives who should ensure that the basic rights of a defendant are upheld. The president and the congress should also exercise ca ution in suspending habeas corpus since it breaches the basic rights in our constitution (Hephaestus Books, 2011). Conclusion In instances where the government suspends habeas corpus, it seeks to address certain security challenges. The details above exemplify the above assertion fully from the Lincoln regime to the Bush era. However, suspension of such a right has encountered legal challenges from courts, which have either outlawed or limited the suspension of this right. Courts undertake a vital role in ensuring that all detainees can challenge their arrest in a court or an appropriate legal system to suit their circumstance. The congress and the president have emerged as key figures in the implementation of this right with the initial passing bills to influence its application. Conversely, the latter issues executive orders to suspend habeas corpus which congress can ratify to ensure legality. Suspension of habeas corpus has exclusively pertained to individuals that pose a signif icant threat to the security of this nation. Conclusively, the suspension of habeas corpus pertains entirely to the security challenges that this nation is encountering. References Chemerisnky, E. (1987). Thinking about habeas corpus. The juveniles might not be in a mature state of mind to face such capital charges. Moreover, the defense has been casting the juvenilesââ¬â¢ guilt on several on other people including their parents. Indeed, in the Deââ¬â¢ Marquise Elkinsââ¬â¢s murder case, the defense attempted to cast guilt upon several others, including the childs parents and the laxity in police investigations (ââ¬Å"Associated Pressâ⬠1). Ideally, the juvenileââ¬â¢s parents are responsible for their childrenââ¬â¢s action and hence have a leeway to prevent them from committing capital crimes for the first time. This supports the opposition against sentencing and incarcerating juveniles for violent crimes. The courts of law should sentence and incarcerate the juveniles as adults for violent crimes because they bear sole responsible for such crimes, their innocent parents cannot bear that guilt, evidence and facts proves their guilt, and they can serve in youth corrections on the juvenile charges as they wait to join adult prisons upon conviction. Indeed, the courts should rely on concrete evidence and convict the responsible suspects regardless of their age. In Deââ¬â¢ Marquise Elkinsââ¬â¢s murder case, the Jurors relied on evidence and deliberated for a long time before finding Deââ¬â¢ Marquise Elkins guilty of 11 counts, including two counts of felony murder and one count of malice murder in the March 21 killing of 13-month-old Antonio Santiago in Brunswick (ââ¬Å"Associated Pressâ⬠1). The court has a duty to place criminal responsibility on the juveniles if they were on sober mind and mental health while committing the capital offenses. Although the juvenileââ¬â¢ s parents have a responsibility over their childrenââ¬â¢s actions, the court should not cast the guilt on such parents if they were innocent. Moreover, Luke in the Acts portrays Paul as a staunch believer of Jesus Christ. In the book of Acts 27, Paul never controlled the storm or the future. However, amidst the impending disaster he appeared the most competent and sober human because he believed in God and had faith that God will deliver him and the others to Rome safely. Therefore, through his God given capability mastering the social environment while still on aboard of the ship makes him stand out as source of hope to the others. These attributes of Paul are depicted all through his letters and teachings. He was strong believer of Jesus Christ; preaching the word of God to the people by encouraging them to have hope and faith in Jesus Christ (Bruce, 1888). Ultimately, in the book of Acts the life of Paul was characterized by threats and arrests from the Romans. However, Luke portrays Paul in the Acts as the light who enjoyed certain benefits while under arrest. For instance, unlike his detention in Caesarea and Jerusalem, he stayed in personal lodgings as indicated in verses 16, 23 and 30 of Acts chapter 28 (Bruce, 1888). Moreover, this can be harmonized to his detention in Rome while writing the epistles to the Ephesians, Colossians, Philippians and Philemon. Therefore, from the aforementioned it is evident that it is possible to harmonize Lukeââ¬â¢s Acts to Paulââ¬â¢s epistles in the New Lillyhttp://www.blogger.com/profile/17006306846284201040noreply@blogger.com0tag:blogger.com,1999:blog-4644940719662654229.post-45293516956936996822019-11-15T07:41:00.001-08:002019-11-15T07:41:03.325-08:00Competitive Advantage of First Mover and Late MoverCompetitive Advantage of First Mover and Late Mover Abstract Nowadays due to technology advancement, the way of how businesses were conducted has evolved to be more globally attributed and dependable to technological innovation aids. Furthermore, technology could help a firm to be sustained by having competitive advantage, and this especially true in the situation of where firm had the strong dependency towards technology innovation. Technology had becomes more important to specific firm or business when it has the ability to significantly affect their competitive advantage or industry structure. Thus, it is important for firms to choose and execute their strategy systematically to stay competitive and sustainable in the market. In this report, the strategy of how firms enter a new market will be discussed in term of first-mover and late-mover, taking into account on the creation of how a firm could be either first mover or late-mover, the advantage and disadvantage of being first-mover and late mover, and lastly giving conclusion and insight of what strategy could be better to be implemented in particular situation. Discussion will begin with explanations and definition of what constitute first mover and their advantage and disadvantages. In this part, researcher Marvin B. Lieberman and David B. Montgomery, 1988 in their article survey about first-mover advantages were referred. They enlighten that there are 3 ways of how first-mover could achieve their advantages. The first sources of how first-mover competitive advantage could be triggered are (i) technological leadership, (ii) preemption of assets, and (iii) buyer switching cost. Technological leadership will benefit first-mover in term of leadership in innovation, which ensure the sustainability in technology. Being the first in the market, provide sustainable cost advantage could be achieved if learning curve could be maintained exclusively. This due to the unit production of cost will fall with cumulative output as explained in standard learning-curve model. As learning curve could be made exclusively, this could also make advantage to the first-mover by setting up extensive barrier to entry. Moreover, preemption of assets help first-mover to achieve advantage in term of domination of market shares. As first-mover could controlled the market shares earlier, this provide a barrier for late entrants to seize an amount of market shares which dominated by first-mover. First-mover also could gain the advantage by preempting the scarce asset. By having the control over existing and available assets, first-mover could deter rival in scarce assets acquisition. Preemption of location in geographic and product characteristics also could lead to advantage for those firm which is first-mover. Being the first-mover, advantage could be achieved through preemption of locations in geographic by entering most viable and profitable market earlier than the rivals. Thus, by implementing strategic action to secure and dominates the market, late-mover will find it is so difficult and viewed it as unprofitable to enter the market. This consequently could deter the subsequent entrants. Furthermore, Research and Development (RD) and patents also secure the first-mover advantages. By having extensive and effective RD, this could lead to discovery of new technology, which could be patented. Thus, as patents exist, this could serve as trade secrets. By doing business as the first-mover, this also provide head start for them to do research and exploit all possible potentially new technology, hence provide numerous patents to protect them from patent-race by future rivals. Buyer switching cost, affect first-mover firm advantages in term of time and resources which will be spent by late-movers in qualifying as a new supplier. Whenever late-mover settle in within firstly occupied market by those first-mover, late-mover had the obstacle and resistance in order to be familiarized by the customers or buyer. This will drop profit margin hence, increase operating cost. This will bring harm to late-mover as the costs incurred are higher compared to the first-mover. Besides, switching cost could surface due to supplier specific learning by the buyer or customer. In this situation, when customers are familiar enough with one specific supplier, they will embrace the brand, and become loyal. Therefore, it is quit difficult for new entrants or late-entrants to steal that loyal customer or buyer from the first-mover firm. Moreover, research by Tariq Malik, 2012 which study the advantage of first-mover for a firm when doing strategic alliances with host companies has showed that there is significant advantage for the first mover. (Malik, 2012) The result of this study has support the hypothesis which are first-mover firm in forming an international alliance in China would perform better than late-mover. This finding seen consistent with literature by Lieberman and Montgomery, 1988, and this is due to first-mover creating an environment which is disfavor by late-entrants. For example, when the first-mover has established relationship between China (Joseph G. Nellis, 1997)firms, through strategic alliances, first-mover has the advantage as they will know on how to do business with China government, organization and media. Moreover, first mover also had the edge over late-move in acquiring strategic location, hired and training the human resources, locked in strategy partner, and has created many consumer loyalties for its technology, products and services. Another empirical study could be seen in Thomas Cleff et. al research of Are there any first-mover advantages for pioneering firms? Lead market oriented business strategies for environment innovation. In this research, it has been found that a successful innovator is not necessarily become the first but one of the first-movers within the competition of different innovation design. Concluding from this study, there is advantage from being the first-mover, however it is depending on the environmental circumstances. This describe that first-mover has higher risk compared to late-mover. Furthermore, through this research, it also found that first-mover advantages are not available and very risky if in condition where suddenly technology changes abruptly. Moreover, increase in market dynamic increases potential of first-mover, however does not guarantee it. It also could be learned that, in order to achieve first-mover advantage, it has to acquire the ability in developing dominant design , so that can be market leader. Lead-market approach also crucial for the first-mover to compete with late-mover, as late-mover could diffuse faster than expected if first-mover does not take lead-market approach. Lead-market approach also crucial in faster and widespread diffusion of new technology, so that could not be surpassed by late-mover. (Thomas Cleff, 2012). In emerging economy, first-mover also has the ability to expand business without attracting much attention from the incumbents from the domestic firm. First-mover also should have the necessary human capital, physical and monetary resources in order to stay in advantages zone, if do not want to be outperformed by the late-mover. To wrap up, in order for first-mover to maintain its profit and advantages, they should be one step ahead of its competitor, however as consequences this will require a high rate of innovation in term of technical and new product development. (Joseph G. Nellis, 1997) First-mover advantages could be seen in various areas such as technology leadership, the domination of asset, and also the switching cost. However, first-mover also could posses several disadvantages, which indirectly will explain as the late-mover advantages. Disadvantages of being the first-mover in the market includes the (i) free-rider effects, (ii) resolution of technological or market uncertainty (iii) shift in technology or customer needs, and (iv) incumbent inertia. Late-mover could have advantage in free-rider effect, as late-mover can imitate where first mover innovate. They can imitate in various part involving the Research and Development (RD), buyer education and infrastructure development. As consequences, they have advantage in cost reduction as imitation is less costly when compared to innovation cost. This ability to imitate then, leads to could reduction of the profitability to first-mover. Resolution of technological or market uncertainty is also one of the advantage of late mover. How late-mover can benefit from this factor is by being late to enter a certain unknown market. This will reduce the risky selection of market, as being first in the unknown market, will serve many challenges and risk to be overcome. As late-mover could delay their time to enter unknown market, they could avoid any unwelcome problem or issues. Shifts in technology or changing in customers need also affect the first-mover and this will be taken advantage by late-mover. Marvin B. Lieberman and David B. Montgomery in their journal has review many literature on how shift in technology or changing customer demand can cause advantage to the late-entrants, which relate to creative destruction model introduced by Schumpt (Schumpter, 1961)er (1961). Through creative destruction model, existing product were said to be obsolete by the emergence of innovation of new firms. This late-entrant then will exploit technological discontinuity which by eliminating and replacing existing incumbent. While customers need something new and this will create dynamic condition. This will create loophole where late-mover could take advantage, unless the first-mover are very fast to alert and respond. While in incumbent inertia, late-mover could be in advantage as late-mover can evade from being locked in specific set of asset. First-mover disadvantage in incumbent inertia also could probably become organizationally inflexible, thus they cannot respond to environmental changes or competitive threats. (Montgomery, 1988) Reviewing from marketing perspective, late mover could be seen as having the potential to leapfrog those first movers at least in two ways either by beating them in their own game, or secondly by surpassing them using innovation as the tool. In term of beating first movers in their own game, late movers approach could start by providing consumers preferences in the category of product positioned by first mover. This could be the source and anchor for competition to start, hence late movers could take the opportunity to see any gap, overlooked superior product positioned, compete on price, or even could take the action to flood the market hence liquefy first moverââ¬â¢s distribution. Whereas, in term of innovation, late mover could innovated their products or strategy, hence could bring the competition between late entrants and first mover come to intense, providing late entrants to surpass first mover. (Venkatesh Shankar, Gregory S. Carpenter and Lakshman Krishnamurthi, 1998). Moreover, study conducted by Venkatesh Shankar, Gregory S. Carpenter and Lakshman Krishnamurthi, 1998 shows that innovation lead to the key of late mover advantage when compared to first movers entrants. First mover or also known as pioneer has the advantage in experiencing higher potential market compare to those late mover. Furthermore, the diffusion and marketing mix effectiveness are unaffected by diffusion of non-innovative late entrants. However, when compared with that late mover with innovative, which is stated as innovative late mover, even higher market potential could be achieved with higher repeat purchase rate compared to first mover. Moreover, innovative late mover claimed to create asymmetry in diffusion as it has unequal response to marketing expenditure, market potential and repeat sales. For example, when first moverââ¬â¢s diffusion take place, consumers will shift to the late-mover products does not affected much due to market shares potential and also consumers preferences towards late mover still strong. However, when innovative late-mover diffuse, they will diffuse faster as they had the more superior innovation and lower price compare to the first-mover. In term of brand growth, pioneer will have to spend a lot of advertising cost, as to create awareness of brand for product and the product category. However, late-mover does not have to prepare such cost, or in other words they could enjoy less expenditure on creating awareness, but only focus on developing brand awareness and could depend on the first-mover to establish the category. They also find the implication of late-mover if, late-mover could not beat first-mover in their own game, which cannot defeat first-moverââ¬â¢s diffusions or marketing strategy, which in turn will cause late-mover will experience low repeats rates and also less effective marketing plan, another way of how late-mover could be in advantage should be discovered. In this situation, what late-mover could do is to lower the price, and spend more on marketing mix. However, it is effective for late-mover to refine their product in which category in compete with the first-mover in order to beat and compete more intensely. (Venkatesh Shankar, 1998). Conclusion In conclusion, being first-mover and late-mover has their own disadvantages and advantages. Thus, in order to implement an entry strategy, the requirement and deep understanding of each firmââ¬â¢s SWOT and the market where they would like to enter is required. To become first-mover in an industry, a firm should possess technological leadership, preemption of asset and also buyer switching cost. In order to maintain first-mover advantage to be sustainable, first-mover should be one step ahead of competitior or late-mover so that learning curve could be made exclusive hence slowing down the innovation process diffusion by the late-mover. In the other side, late-mover could have the advantage in term of free-rider effect, which focuses on imitation or refining of the first-mover product category. However, late mover must be aware that if first-mover is very fast in product innovation and development, hence slowing down product diffusion in the market, focus on quality and pricing cou ld be made. Finally, to choose either first-mover or late-mover is the best strategy is depending on the requirement, circumstances, market condition, assets and also firmââ¬â¢s capacity and capability.
